課程目標

本課程目標為使學生了解與應用勞工安全衛生法及其所衍生之法規,包括勞工安全衛生法施行細則,勞工安全衛生組織管理及自動檢查辦法,勞工健康保護規則,工業安全衛生標示設置準則等,並達成本系勞動法令與政策專業知識、職場安全與健康專業知識養成之教學目標。 This course is to study the regulations for labor safety and health including Labor Safety and Health Law, and Enforement Rules of the Labor Safety and Health Law, etc.

課程概述

勞工安全衛生法為我國主要管理職業安全與健康之國家層級法規,其規範對象包括雇主(事業主或事業之經營負責人)及勞工(受僱從事工作獲致工資者)。立法目的為防止職業災害(勞工就業場所之建築物、設備、原料、材料、化學物品、氣體、蒸氣、粉塵等或作業活動及其他職業上原因引起之勞工疾病、傷害、殘廢或死亡),保障勞工安全與健康。法規內容包括安全衛生設備、安全衛生管理、監督與檢查、罰則。雇主的職責為:(1)維持或採用必要及適當的設備以保護勞工的工作安全;(2)熟悉並遵守法規標準;(3)確保勞工使用必要之個人安全衛生防護具。為達成勞工安全衛生法之要求,中央主管機關已訂定各相關規則,包括毒性物質、有害物理因子、電氣危害、墜落危害、有害廢棄物、傳染病、火災爆炸危險、有害氣體、機械危害及侷限空間。 Labor Safety and Health Law is the primary national law which governs occupational safety and health. The applied subjects are employers (the owner of an enterprise, or the person in a position of managerial responsibility for such an enterprise) and labors (a person employed to undertake work in exchange for wages). This Law is enacted for the purpose of preventing occupational accidents (any disease, injury, disability, or death caused by building structures, equipment, raw materials, ingredients, chemicals, gas, vapor, dust, etc., in the place of employment, or as a result of the performance of duty, or because of other occupational causes) and protecting labor safety and health. The Law contains safety and health installations, safety and health management, supervision and inspection and penalties. The general duties of employers are: (1) Maintain conditions or adopt practices reasonably necessary and appropriate to protect workers on the job; (2) Be familiar with and comply with standards applicable to their establishments; and (3) Ensure that employees have and use personal protective equipment when required for safety and health. For the purpose of this Law, competent authority of the central government has enacted extensive regulatory rules to meet its obligations. Major areas which its standards currently cover are: Toxic substances, harmful physical agents, electrical hazards, fall hazards, hazardous waste, infectious disease, fire and explosion dangers, dangerous atmospheres, machine hazards, and confined spaces.
